Welcome to Pratima and Pratima.app, a mobile application available on Android and web page available in World Wide Web (hereinafter referred to as the "App"). Please read these Terms and Conditions carefully before using the App. By downloading and using the App, you agree to be bound by the following terms and conditions. If you do not agree to these terms, please refrain from using the App.

1. Use of the App

1.1.  

The App is providedto the User under a non-exclusive, non-transferable license, revocable at thediscretion of the App developer. This license grants the User permission to usethe pratimani – digital depictions of Hindu traditional, ritual, and/or auspicioussymbols and depictions of Hindu gods (hereinafter referred to as"Content") for personal, non-commercial purposes only. The Appdeveloper reserves the right to terminate this license at any time, withoutnotice, for any reason. The User may not modify, reproduce, distribute, orexploit the Content for any other purpose beyond the scope explicitly stated inthese Terms and Conditions.

1.2.  

To fully experience the calming, concentrating and developmental influence of the Content, developers recommend creating a widget on Users device's home screen. This widget allows the Content to be readily available, offering you inspiration and guidance at Users fingertips.

1.3.  

The App uses Users device's location services to provide accurate sunrise, sunset, moonrise, and moonset timings for Users specific location. This information is provided for User convenience and is based on User device's location data. Location data is processed ephemerally and is not stored or used for any other purpose.

1.4.

Users are required to go through verification procedure to access the App, including purchasing and accessing purchased Products.
1.4.1 Users can be verified by entering their mobile number and country code. An OTP (One-Time Password) will be sent via WhatsApp to the provided mobile number for verification. Users must enter the OTP within the App to verify their number and complete the registration process.
1.4.2. Alternatively, Users may be verified using their Google account by selecting the "Continue with Google" option. This allows for a quicker and more seamless verification process.
1.4.3. Upon successful verification, Users will have access to the App, where purchased Products will be linked and accessible for future use.
1.4.4. The User is responsible for maintaining the confidentiality of their verification credentials. The App developer will not be liable for any loss or damage arising from the User's failure to safeguard their verification information.

2. Content and Guarantees

2.1.  

All Content available in the App is protected by copyright laws and owned by the App developer.

2.2.  

The App provides digital depictions of Hindu traditional, ritual and/or auspicious symbols and depictions of Hindu gods for artistic, cultural and informational purposes. They are not intended to replace any philosophical, emotional, or medical treatment. The App developer and content providers hold no responsibility or liability regarding the influence, impact, or reliability of the depictions, symbols, or content on the user's well-being or any astrological effects on human physiology.  While we strive for accuracy and quality, we do not guarantee the efficiency, accuracy, or completeness of the depictions. The use of these symbols, and content is at the discretion and will of the user, and the App developer does not assume responsibility for any effects or consequences resulting from the use of these products or services.

2.3.  

In addition to digital depictions, the App also provides information about the depictions and a calendar listing of Hindu festivals and holidays with short descriptions of each. This information is for informational purposes and should not be considered a comprehensive source of information.
2.3.1. The graphical content within the calendar section is sourced from two primary locations:
CC License Pictures: Certain images are sourced from Pexels.com, an online platform providing high-quality images under open licenses, allowing for their use in various contexts.
Historical Figures: Images of historical figures are sourced from Wikipedia, a collaborative online encyclopedia. These images are utilized in accordance with Wikipedia's licensing and usage guidelines.
2.3.2. It's important to note that the use of these images is for informational and illustrative purposes within the context of the calendar section. Users are encouraged to explore the provided information and enjoy the visual representation of historical figures and events.
2.3.3. While efforts are made to ensure the accuracy and appropriateness of the sourced images, the App developer does not claim ownership of these images and relies on the open licenses and permissions provided by Pexels.com and Wikipedia. The App developer holds no responsibility for any discrepancies in the licensing information provided by these sources. Users are advised to refer to the respective platforms for detailed licensing information.

2.4.  

The App developer may update or modify the Content and the calendar information at any time without notice. We do not guarantee the availability of specific Content or features in the App.

3. In-App Purchases

3.1.  

The App offers in-app purchases of Products. These purchases are made through the Google Play Store and are subject to its terms and conditions. Prices for Products are displayed in the local currency of the user’s geographic location and are inclusive of applicable taxes.

3.2.  

To complete a purchase, users must select the desired Product and proceed with the payment through the available methods in their country (e.g., credit card, debit card, mobile billing, Google Play balance). Upon successful completion, the purchased Product will be linked to the user’s Pratima account and will remain accessible unless removed by the user.

3.3.  

All purchases of Products are one-time transactions. Once purchased, Products are permanently accessible within the user’s account and are non-refundable, except as required by applicable law or in accordance with Google Play's "Return and Refund Policy."

3.4.  

Users are responsible for ensuring that the payment details provided are accurate and that they have sufficient funds or credit to complete the purchase. By initiating a payment, users authorize Google Play and the Pratima app to process the transaction using the selected payment method.

3.5.  

Prices for Products may vary based on exchange rates and local taxes and are subject to change without prior notice. However, such changes will not affect any Product already purchased by the user.

3.6.  

Users will receive a receipt for each purchase sent to the email associated with their Google Play account. Transaction history can be viewed under "Order History" in the Google Play Store.

3.7.  

All transactions are processed through Google Play’s secure payment gateway. The Pratima app does not store any payment information. Users are advised to keep their Google Play account details secure and confidential.

4. Privacy and Data

4.1.

App may collect and use certain information as described in the Privacy Policy. By using the App, User agree to our Privacy Policy's terms.

5. Intellectual property

5.1.

All trademarks, service marks, trade names, trade dress, and other forms of intellectual property within the App are proprietary to the App developer. No information, code, algorithms, content, or material from the App may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the express written permission of the App developer.

5.2.

Users are expressly prohibited from reverse engineering, decompiling, or disassembling the App, or any part thereof. Any unauthorized use of the intellectual property rights belonging to the App developer may result in legal action.

5.3.

Certain content within the App may be subject to intellectual property rights owned by third parties. Such third-party content is used with the necessary permissions or licenses. Users are required to respect the intellectual property rights of these third parties as specified by the respective licenses or permissions associated with such content.

5.4.

If you believe that the App or its content infringes upon your intellectual property rights, please contact us at namaste@pratima.app with detailed information, and we will promptly investigate and take appropriate action.

5.5.

The intellectual property rights granted herein are for the educational and non-commercial use of the App. Any use beyond these parameters requires explicit written consent from the App developer.

5.6.

The App developer holds no responsibility for any unauthorized use of intellectual property by users. Users are solely responsible for ensuring compliance with these terms and applicable laws regarding intellectual property rights.

6. Termination

6.1.

The App developer reserves the right to terminate User’s access to the App at any time without notice, for any reason.

7. Changes to Terms and Conditions

7.1.

The App developer reserves the right to change these Terms and Conditions at any time. Users are responsible to check the Terms and Conditions periodically to remain in compliance with these terms.

7.2.

User’s continued use of the App after any changes constitute acceptance of the updated terms.

8. Governing Law and Jurisdiction

8.1.

These Terms and Conditions are governed by and construed in accordance with the laws of Poland. User agree that any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts in Poland.
